
Litigation Support
BBG’s litigation support services group can provide litigation support services for any type of litigation which involves real property.
These can include: matrimonial cases, bankruptcy, estate tax and IRS audits, damage cases and disputes between owners/parties. Our appraisers assist litigation counsel in developing winning strategies and provide litigation quality narrative appraisal reports required for various courts, including Federal Court, as well as provide expert testimony in court. Our appraisers can also provide critiques of the other appraisers’ reports or formal rebuttal reports. We can also prepare trial exhibits to be used at the trial itself.
Eminent Domain
Eminent domain is the right of the government or its agent to expropriate private property for public use, with the payment of just compensation. BBG’s support services group can provide litigation support services in connection with condemnations of real property. BBG’s litigation team has worked for numerous condemnors like the New York City Metropolitan Transportation Authority, the Port Authority of New York & New Jersey, the New York City School Construction Authority, Amtrak, New Jersey Transit, the New York City Law Department – Corporation Counsel and Consolidated Edison, as well as their outside condemnation counsel. The team also works for condemnees (private property owners) and their condemnation counsel, both in negotiations with the condemning authority and by providing expert testimony in contested proceedings to determine the appropriate value of the condemned property to ensure just compensation.
Expert Witness Testimony
The role of a good expert witness in a litigation or a condemnation case cannot be overlooked. The expert witness will work with counsel to develop winning strategies but must also have experience testifying in court and must also be able to qualify as an expert witness. Not only does BBG’s litigation support services group provide expert reports, but the group has experienced real estate appraisers who have repeatedly testified in Federal Tax Court, Federal Bankruptcy Court-Southern District of New York, various state supreme courts and surrogates’ courts as qualified experts.
Arbitration
Arbitration is the use of an arbitrator to settle a dispute. Arbitration services are needed to help property owners resolve disputes outside of the court system. There are typically two party arbitrators and a third “neutral” arbitrator involved in the arbitration itself. BBG’s litigation group has appraisers who have routinely acted as party arbitrators for ground rent renewals, office rent renewals, garage rent renewals, retail rent renewals and disputes between private property owners. We are also experienced in the process of baseball arbitration. Our experienced appraisers would also be willing to serve as a “third” neutral arbitrator to issue a decision to resolve the dispute between the two parties, or the party arbitrators.
Mediation
Mediation is defined as intervention in a dispute in order to resolve it. BBG’s litigation support services group can provide appraisal services in connection with your mediation. We can provide a formal appraisal report to be used at the mediation and we can assist you at the mediation itself.

Eric P. Haims is a Managing Director at BBG, Inc. in the NYC office. With 30 years of commercial real estate appraisal and consulting experience, he has appraised thousands of commercial properties located in the Metropolitan New York area and across the country. Eric’s primary market area is the five boroughs of New York City and Eric’s secondary market area is the surrounding Counties of Westchester, Putnam, Dutchess, Nassau, Suffolk, as well as Southern Connecticut/Fairfield County and Northern New Jersey/Bergen, Morris, Essex and Hudson Counties. Eric’s concentration is on Valuation, Litigation and Support Services, Expert Witness Testimony, Arbitrations, Appraisal Review, Discounted Cash Flow Analysis, Estate Tax and Planning, Gift Tax, Matrimonial, Tax Appeal, Consulting, Land Valuation and the Valuation of TDRs.
Eric also specializes in the appraisal of commercial properties for both litigation and condemnation purposes pursuant to eminent domain, including assisting in the preparation of expert witness testimony for both direct and cross examination and the writing of rebuttal reports. Eric has appeared as an expert witness on real estate valuation in Federal Tax Court, the Surrogates Court of Kings County, United States Bankruptcy Court-Southern District of New York, New York State Supreme Courts in Manhattan, White Plains, Jamaica, Queens and Syracuse, New York and Supreme Court of New Jersey, Hudson County.

Louis Izenberg is Managing Director at BBG Inc. in the New Jersey office, formerly known as Izenberg Appraisal Associates. He has been providing appraising and consulting services since 1985 with a concentration in litigation. His practice is diversified encompassing the valuation and evaluation of commercial, industrial, special purpose and large complex residential projects.
Mr. Izenberg’s experience includes subdivision analysis, feasibility studies, regional and community shopping centers, malls, office buildings, manufacturing and warehouse properties, apartment complexes, cooperative buildings, mobile home parks, adult health care facilities, quarries, hotels/motels, casinos and golf & country clubs.

For more than four decades, Phil and his team have served law firms, government agencies, and private property owners, among other clients, in complex appraisal assignments, often involving litigation.
The Salt Lake City office assignments include eminent domain disputes, state and local property tax disputes, bankruptcy, foreclosure and loan deficiency, construction defects, real estate damages, breach of contract, appraiser liability, class-action certification, property acquisition and disposition assistance, and feasibility analysis. Other areas of expertise include appraisal services for financing, securitization, and income and estate tax.
J. Phillip Cook, MAI, CRE

Corey A. Cook has almost 20 years experience appraising and consulting experience and holds a B.A. degree from Brigham Young University and an MBA degree from Purdue University. He is a certified appraiser in Utah and has been involved in assignments throughout the western United States. His experience covers all real estate markets including land, residential and commercial properties, large golf- and ski-oriented master planned communities and other land development projects, special-purpose and recreational properties, gravel properties, and a variety of other income producing assets including oil and gas leaseholds and gas gathering and processing facilities. His primary focus is complex assignments and impaired real estate. His work often supports expert testimony and decisions made in eminent domain and condemnation proceedings, property tax disputes, real estate damages including construction defects matters and fire-burned property, bankruptcy, estate planning matters, and cases involving breach of contract, among other things. His list of clients includes individuals, city, county, state, and federal government, financial institutions and mortgage companies, insurance and pension funds, professional firms, and public and private corporations.
